HENRICO COUNTY, Va. (WRIC) — A Henrico County father who was charged with killing his baby daughter is now a free man.

Diquan Burns was found not guilty of charges of murder and child neglect in connection to the January death of his seven-week-old daughter, Trinitie Burns.

According to grand jury indictments, police believed the father accidentally killed his baby girl after the infant suffered a skull fracture and two brain bleeds.

Police say D. Burns was taking care of Trinitie at his parents’ eastern Henrico home when he told investigators he went to “grab her out” of her swing when “the back and right side” of Trinitie’s head hit that swing.

The infant’s mother arrived the next day to find a knot on the right side of her daughter’s head. The baby wouldn’t wake up. Both parents took Trintie to the hospital. She died four days later.
