“Modern Family” star Sofia Vergara is in the middle of a legal battle with her ex-fiancé over two frozen embryos.

Six months before Vergara and businessman Nick Loeb broke up in November 2013, they used in-vitro fertilization to create embryos. The plan was to eventually use a surrogate.

The two share a signed agreement that says the embryos should be destroyed in the event of either or both of their deaths. But Loeb, who is pro-life, filed a complaint in court to prevent the embryos from ever being destroyed. Loeb claims Vergara would not agree.

The complaint is not alleging that Vergara is actively trying to destroy the embryos.

In the lawsuit, Loeb also claims that Vergara physically abused him on four separate occasions.

Vergara is currently engaged to “Magic Mike” star Joe Manganiello.
