Lawsuit In Immigrant DUI Crash That Killed Nun

MANASSAS, Va. (AP) – Prince William County has sued the federal government to get information about why an illegal immigrant who killed a nun in a drunken driving crash had been released from custody pending a deportation hearing.

The county's suit, filed in federal court in Virginia, seeks a report explaining why Carlos Martinelly Montano was freed from custody before the crash last August.

Montano had been arrested twice before and charged with drunken driving. He had been turned over to U.S. Immigration and Customs Enforcement, but was released in 2008 pending an immigration judge's ruling on the case. That decision had not come at the time of last summer's crash.

Corey Stewart, the chairman of the county Board of Supervisors, says the Department of Homeland Security has stonewalled the county's request for information.
